The following terminology applies to these Terms of Service and Store Policies and any or all Agreements: Throughout the site, the terms "we", "company "our" and "us", refers to Royalty Designs. The use of the terms "client", "customer" and "you" refers to any consumer of our products and/or services. By visiting our site and/or purchasing from us, you engage in our "Service" and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site. including without limitation users who are browsers, clients, and/or contributors of content.

Royalty Designs reserves the right to change the Terms and Conditions of the Agreement and such modifications shall be effective immediately. Users should visit this page periodically to review the Terms and Conditions because they legally determine the conditions under which they are allowed to use the service. A user's continued access to this website shall be deemed acceptance of the modified agreement.

Copyright & Trademarks

By supplying text, images, and other data to Royalty Designs for inclusion in the customer’s website or other projects, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.

Any artwork, images, or text supplied and/or designed by Royalty Designs on behalf of the customer, will remain the property of Royalty Designs and/or its suppliers unless otherwise agreed in writing. A license for use of the copyrighted material is granted to the customer solely for the project defined in the scope or request and not for any other purpose.

​

Any software, code, plugin, or other third-party material used in a web or digital project remains the property of the creator, and any ongoing license fees or fees for upgrades are the responsibility of the client, not Royalty Designs.

​

Ownership of copyright over all concepts and drafts remains with the Company. This includes, but is not limited to; logos, symbols, and final designs. Unlawful use of these designs by the Client is strictly prohibited. The use of designs before payment is illegal.

​

The customer agrees to fully indemnify and hold Royalty Designs free from harm in any claims resulting from the customer not having obtained all the required copyright, and/or any other necessary permissions.

• Re-sell, duplicate, copy or redistribute content from www.royaltydesigns.shop

Alterations

The customer agrees that changes requested over and above the estimated work, or in addition to the agreed scope, or the client requests changes to a design after acceptance of the final delivery, will be required to pay an extra fee for additional revisions.

The customer is held responsible for approving all final designs, rough layouts and ensuring accuracy and suitability. This includes, but is not limited to; design, spelling, grammar, illustrations, images, and quantity. It is the responsibility of the customer to request another copy of the design that is difficult to read or changes are required.

​

The customer also agrees that Royalty Designs holds no responsibility for any amendments made by any third party, before or after a design is published.

​

Data Format

The client agrees to Royalty Designs' definition of acceptable means of supplying data to the company.

​

Text is to be supplied to Royalty Designs' in electronic format as standard text (.txt), Google Docs, or MS Word (.docx) sent through email.

​

Images and videos that are supplied in an electronic format are to be provided through Google Drive, Email, or iCloud and shared with the designer. All media must be of a quality suitable for use without any subsequent image or video processing, and Royalty Designs will not be held responsible for any image quality which the client later deems to be unacceptable.

​

Design Project Duration

Any indication given by Royalty Designs of a design project’s duration is to be considered by the customer to be an estimation. Royalty Designs cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by Royalty Designs for the initial payment or by the date confirmed in writing by Royalty Designs.

Design Project Completion

Royalty Designs considers the design project complete 7 days after the delivery date. Other premium services or custom orders such as website designs and video editing will be marked as complete after an invoice or approval form is signed. The client has up to 7 days after delivery to sign the required document. If the document isn't signed within the given period the order will be automatically marked as complete by the designer.

Design Credits

The customer agrees to allow Royalty Designs to place a small credit on advertisements and/or a link to the Royalty Designs' website (www.royaltydesigns.shop) on the customer’s website. This will usually be in the form of a small logo or line of text placed on the footer of a page.

The customer also agrees to allow Royalty Designs to place websites and other designs, along with a link to the client’s site on Royalty Designs' website for demonstration and sample work purposes and to use any designs in its publicity and portfolios.

Payments

Royalty Designs reserves the right to request a deposit from the client before starting work on their project or design. If a deposit is requested by the Company, an invoice will be generated and delivered to the client via email, and payment is expected. By remitting deposit funds to the Company, the Client is accepting the Terms and Conditions and entering a contract with the Company.

 

If a deposit is not requested, the Client is considered to accept the Terms and Conditions upon request of services/work from the Company.

 

The Company will invoice the Client for the remaining cost of the project and associated services before the commencement of website design or any premium services. The Company reserves the right to not proceed with these services until payment has been received in full from the Client.

 

It is the Client's responsibility to approve of any final delivery. Royalty Designs reserve the right to delete the website or any completed designs if the client fails to contact the designer within 7 days of the delivery date. Deleted designs cannot be recovered and the Client would need to repurchase another design after the project has been completed.

Charges for Other Services
Charges for any additional services requested during the project that are over and above the estimated turnaround or out of scope will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.

​

Website Design Only

Royalty Designs requires that a template or rough layout is approved by the customer before the coding of a site commences. Once the template(s) for the website are approved by the customer, coding will commence; any changes to navigation items, colors, structure, or content that require changes to the template will incur an additional charge.

​

Hosting Website

Royalty Designs offers limited hosting services through an outsourced virtual server. Royalty Designs does not guarantee continuous service and will accept no liability for loss of service, whatever the cause.

​

Royalty Designs may request that clients change the type of hosting account used if that account is deemed by Royalty Designs to be unacceptable because of poor service, lack of bandwidth, or in any other way insufficient to support the website. Fees for hosting on Royalty Designs' virtual server are due at the commencement of any period of service and are non-refundable.

​

Fees due to third-party hosting organizations after initial payment during the project duration are the responsibility of the client.  Royalty Designs is not liable for their payment, nor for the renewal of domain names or website plans, which are the sole responsibility of the customer/domain owner.

​

Once web design is complete, Royalty Designs will provide the customer with the opportunity to review the resulting work. Royalty Designs will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to the placement of items on the page. It does not include changes to images, color schemes, or any navigation features. Any minor changes can be notified to Royalty Designs by e-mail.

Domain Registration

Royalty Designs cannot guarantee the availability of any domain name. Where Royalty Designs is to register a domain name on behalf of a client it will endeavor to do so but the client should not assume a successful registration of the domain is unavailable.

​

Search Engine Submission

Due to the infinite number of considerations that search engines use when determining a site’s ranking, Royalty Designs cannot guarantee any particular placement. Acceptance by any search engine cannot be guaranteed and when a site is accepted, the time it takes to appear in search results varies from one search engine to another. Rankings will also vary as new sites are added. Royalty  Designs' recommends that customers use a professional SEO company and are happy to provide details of such companies, but accept no responsibility for their services.

The Company builds and designs websites to the best of our knowledge at the time of completion. The Company cannot take responsibility if the customer's site is “hacked” or maliciously attacked in form. The company will not be held responsible and is not liable for any loss of income to arise from the customer's website “going down”, being hacked, or otherwise. The Company does not provide software updates or take responsibility if the software used becomes out of date and obsolete. The Company does not take responsibility for any unforeseen advancements in technology that may have negative effects on many aspects of the client's site or

system.

Rights of Access for Website Design

The client agrees to allow Royalty Designs all necessary access to computer systems and other locations, as required, to complete a website project and until all due funds are cleared, including the necessary read/write permissions, usernames, and passwords.

​

The customer also agrees to allow Royalty Designs access to any computer systems, usernames, and passwords required to remove data and/or sites for failure to comply with these Terms and Conditions.

​

The customer agrees to supply Royalty Designs with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them promptly. 

​

Rights of Refusal

Royalty Designs will not include in its designs, any text, images, or other data that it deems to be immoral, offensive, obscene, or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities. Royalty Designs also reserves the right to refuse to include submitted material without giving a reason. In the situation where any images and/or data that Royalty Designs does include in all good faith, and subsequently discovers is in contravention to such Terms and Conditions, the customer is obliged to allow Royalty Designs to remove the contravention without hindrance, or penalty. Royalty Designs is to be held in no way responsible for any such data being included.

Disclaimer

Royalty Designs makes no warranties of any kind, express or implied, for any products and/or services that it supplies. Royalty Designs will not be held responsible for any damages resulting from products and/or services it supplies. Royalty Designs is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Royalty Designs responsible for any such loss or damage. Any claim against Royalty Designs shall be limited to the relevant fee(s) paid by the customer.

Royalty Designs reserves the right to use the services of sub-contractors, agents, suppliers, and any work, content, services, and usage is bound by their Terms and Conditions. Royalty Designs will not knowingly perform any actions to contravene these and the client also agrees to be so bound.

General

These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Royalty Designs reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.

Acceptance of Terms Of Use and Quotation

​

The placement of an order for design and/or any other services offered by Royalty Designs, by email, verbally, or in writing, is deemed to be acceptance of these terms and conditions, which are freely available at www.royaltydesigns.shop.

​

An estimate validated by the customer’s signature on the estimate or quotation form, or by email, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms Of Use and forms a Contract for Business between the signatory and Royalty Designs.
